These Terms of Service ("Terms") govern your use of the Tondazo platform and services ("Service"), operated by Tondazo ("we," "us," or "our"). By signing up or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Tondazo provides an AI-powered follow-up service for home service contractors. Our AI agent ("Alexandra") contacts homeowners on your behalf, qualifies leads, and hands off warm prospects to you. You submit leads through the contractor portal; we follow up for you.
The Service is available to licensed home service contractors and businesses operating in the United States or Canada. By using the Service you represent that:

Tondazo is not liable for any losses arising from your failure to follow up on handed-off leads in a timely manner.
You may not use the Service to:
Subscription fees are billed monthly in advance at the rate corresponding to your selected plan. Fees are non-refundable except as required by applicable law. Failure to pay may result in suspension or termination of your account. Prices are listed in USD and are subject to applicable taxes.
Tondazo offers a limited "Founding Member" pricing tier to the first fifteen (15) contractors who enroll during the founding enrollment period. The following terms apply specifically to accounts holding Founding Member status:
6.1 Non-Transferable. Founding Member pricing is granted to the individual owner and named legal entity that enrolled. It cannot be transferred, assigned, sublicensed, or conveyed to any other person or entity — whether by sale, gift, inheritance, corporate restructuring, or otherwise.
6.2 Change of Control. If your business is acquired, merged with another entity, sold, or undergoes any change in majority ownership or control, Founding Member pricing terminates automatically on the date that transaction closes. Your account will revert to Tondazo's then-current standard pricing for your plan tier on the next billing cycle following the change. You agree to notify Tondazo within 30 days of any such transaction.
6.3 Account Integrity. If Tondazo reasonably determines that an account is being operated by or on behalf of a different legal entity than the original enrollee — evidenced by changes to billing contact, company name, registered email domain, tax identification, or material changes in usage patterns — Tondazo may review and revoke Founding Member pricing with 30 days' written notice.
6.4 Plan Upgrades. The founding rate applies to the plan tier selected at enrollment. If you upgrade to a higher plan, the founding discount will apply to that tier only if Tondazo confirms the extension in writing at the time of upgrade.
6.5 Good Faith Commitment. Tondazo intends to honour the founding rate for the lifetime of your account, provided the account remains under the original enrollee. In the event of extraordinary circumstances requiring a pricing change — such as an acquisition of Tondazo or regulatory requirements — we will provide no less than 90 days' advance written notice before any change to your founding rate takes effect.
We aim to maintain high availability but do not guarantee uninterrupted service. Alexandra's follow-up calls are typically initiated within minutes of lead submission during business hours. Call volume, timing, and follow-up frequency may vary based on your plan and lead queue.
All platform software, design, and content is owned by Tondazo. You retain ownership of the lead data you submit. By submitting data, you grant us a limited license to process it solely for the purpose of delivering the Service.
Both parties agree to keep confidential any non-public information shared through the Service. We will not sell your lead data to third parties. Lead information is used exclusively to deliver your follow-up calls.
Either party may terminate the subscription at any time. You can cancel through the portal or by emailing team@tondazo.com. Upon termination, your access will end at the close of the current billing period. We reserve the right to terminate accounts that violate these Terms immediately and without refund.
To the maximum extent permitted by law, Tondazo's total liability to you for any claim arising from the Service is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost revenue, lost leads, or missed opportunities.
The Service is provided "as is." We do not guarantee any specific lead conversion rate, call outcome, or revenue result. Results vary by contractor, market, and response time.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts of Ontario unless you are a U.S.-based contractor, in which case applicable U.S. federal law may also apply.
We may update these Terms from time to time. We will notify you via email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
